The Applicant was originally charged with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code. He entered into a plea bargain agreement with the Respondent and was convicted on his own plea of guilty for the lesser offence of manslaughter contrary to Section 202 as read with Section 205 of the Penal Code. The trial court sentenced him to serve six (6) years’ imprisonment. The Applicant has served 2 years and 5 months of his sentence and is remaining with a further 1 year and 5 months after remission. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Samwel Chuma does not recommend a non-custodial sentence. I direct that the Applicant shall continue to serve the remainder of his sentence in custody.
