(From the original Conviction and Sentence in the Chief Magistrates’ Court at Nyamira, Criminal Case No. E131 of 2024 by Hon. B. Okong’o Resident Magistrate on 20th March 2024.)
The Applicant was convicted on his own plea of guilty for the offences of threatening to kill contrary to Section 223 (1) of the Penal Code and malicious damage to property contrary to Section 339 (1) of the Penal Code. The trial court sentenced him to pay a fine of Kshs. 50,000/= or to serve one and a half years’ imprisonment in default. The Applicant has served 5 months of his sentence and is remaining with a further 7 months to serve after remission. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Nelson Maroa does not recommend a non-custodial sentence. I hereby direct that the Applicant shall continue to serve the remainder of his sentence in custody.
