(From the original Conviction and Sentence in the Chief Magistrates’ Court at Nyamira, Criminal Case No. E124 of 2024 by Hon. W.K. Chepseba Chief Magistrate on 9th February 2024.)
The Applicant was convicted on his own plea of guilty for the offences of housebreaking contrary to Section 304 (1) (b) and stealing contrary to Section 279 (b) of the Penal Code. The trial court sentenced him to serve 4 years’ imprisonment for both counts. The Applicant has served 7 months of his sentence and is remaining with a further 2 years to serve after remission. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Nelson Maroa recommends a non-custodial sentence. I hereby direct that the Applicant shall serve a Community Service Order at the Nyamira Police Station under the supervision of the Probation Officer Mr. Nelson Maroa and the Officer Commanding Station for 5 months.
