(From the original Conviction and Sentence in the Chief Magistrates’ Court at Nyamira, Criminal Case No. E554 of 2022 by Hon. W.C. Waswa Resident Magistrate on 27th May 2022)
The Applicant was convicted on his own plea of guilty for the offences of housebreaking contrary to Section 304 (1) (b) and stealing contrary to Section 279 (b) of the Penal Code. The trial court sentenced him to serve 5 years’ imprisonment for each count. Both sentences were to run concurrently. The Applicant has served 2 years and 4 months of his sentence and is remaining with a further 1 year after remission. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Nelson Maroa recommends a non-custodial sentence. I hereby direct that the Applicant shall serve a Community Service Order at Sengera Police Station under the supervision of the Probation Officer Mr. Nelson Maroa and the Officer Commanding Station.
