The Applicant was convicted of the offence of malicious damage to property contrary to Section 339 (1) as read with Section 339 (2) of the Penal Code. The trial court sentenced him to pay a fine of Kshs. 150,000/= or to serve 4 years’ imprisonment in default. The Applicant has served 2 years and 2 months and is remaining with six months to complete his sentence. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Nelson Maroa recommends a non-custodial sentence. I hereby direct that the Applicant serves a Community Service Order at the Assistant Chiefs’ Office in Boisanga 1 location under the supervision of the Probation Officer Nelson Maroa and the area Assistant Chief.
Orders accordingly.
