The Applicant was charged and convicted with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code. The trial court sentenced him to serve ten (10) years’ imprisonment. The Applicant has served 4 years of his sentence and is remaining with a further 2 years and 8 months after remission, to complete his sentence. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Mr. Nelson Maroa recommends a non-custodial sentence. I hereby direct that the Applicant shall serve a Community Service Order at the Nyamira County Forest Services in Nyamira South Sub-County Nurseries under the Ministry of Environment, Climate Change and Forestry. He will be supervised by the Nyamira Probation Officer, Mr. Nelson Maroa and the Nyamira County Chief Conservator for remainder of his sentence.
