The Applicant was charged with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code. He was convicted of the lesser offence of manslaughter contrary to Section 202 as read with Section 205 of the Penal Code. The trial court sentenced him to serve ten (10) years’ imprisonment. The Applicant has served 4 years and 10 months of his sentence and is remaining with a further 1 year and 10 months after remission. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Nelson Maroa recommends a non-custodial sentence. I hereby direct that the Applicant shall serve a Community Service Order at Nyamira County Forest Services in Keroka Sub-County Nurseries under the Ministry of Environment, Climate Change and Forestry. He will be supervised by the Probation Officer Nyamira, Mr. Nelson Maroa and the Nyamira County Chief Conservator for remainder of his sentence.
