(From the original Conviction and Sentence in the Chief Magistrates’ Court at Nyamira, Criminal Case No. E427 of 2022 by Hon. W.K. Chepseba, Chief Magistrate on 15th February 2023.)
The Applicant was convicted on his own plea of guilty for the offence of Obtaining money by false pretences contrary to Section 313 of the Penal Code and Cheating contrary to Section 315 of the Penal Code. The trial court sentenced him to serve two and a half years imprisonment for each count. Both sentences were to run concurrently. The Applicant has served 1 year and 6 months of his sentence. He is remaining with one month to complete his sentence after remission which will be 14th October 2024. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Nelson Maroa recommends that he completes his sentence in custody so that he can benefit from State rehabilitation. I hereby direct that the Applicant shall continue to serve the remaining part of his sentence in custody.
Orders accordingly.
