(From the original Conviction and Sentence in the Chief Magistrates’ Court at Nyamira, Criminal Case No. E853 of 2021 by Hon. W.C. Waswa Resident Magistrate on 30th November 2021)
The Applicant was convicted on his own plea of guilty for the offence of assault causing actual bodily harm contrary to Section 251 of the Penal Code, Cap 63 Laws of Kenya. The trial court sentenced him to serve 5 years’ imprisonment. The Applicant has served 2 years and 9 months of his sentence and is remaining with 7 months after remission to complete his sentence. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Mr. Samwel Chuma does not recommend a non-custodial sentence. I hereby direct that the Applicant shall continue to serve the remainder of his sentence in custody.
