(From the original Conviction and Sentence in the Senior Principal Magistrates’ Court at Keroka, Criminal Case No. E646 of 2023 by Hon. M. Munyekenye, Senior Principal Magistrate on 9th October 2023.)
The Applicant was convicted on his own plea of guilty for the offences of Personating a Public Officer contrary to Section 105 (b) of the Penal Code and Possession of Public Stores contrary to Section 324 (2) as read with Section 36 of the Penal Code. The trial court sentenced him to serve three (3) years’ imprisonment for the two counts. The sentences were to run concurrently. The Applicant has served eleven (11) months and is remaining with thirteen (13) months after remission, to complete his sentence. The Sentence Review Report filed on 3rd September 2024 by Senior Probation Officer Mr. Samwel Chuma recommends a non-custodial sentence. I hereby direct that the Applicant serves a Community Service Order at Sosera Primary School under the supervision of the Nyamira Probation Officer Mr. Samwel Chuma and the school headteacher.
Orders accordingly.
