RULING
1. The Application dated 12.11.2025 be and is hereby allowed in the following manner.
a) The Order of dismissal made on 26.06.2025 is hereby set-aside and/or vacated.
b) The matter will proceed for full hearing.
c) The Plaintiff is directed to prepare, file and serve their trial bundle within seven (7) days from today’s date.
d) The 1st and 3rd Defendant s are directed and/or leave of fourteen (14) days from today’s date to prepare, file and serve any further list of documents and/or statements they seek to rely upon at the hearing.
e) The 6th Defendant is also granted leave of fourteen (14) days to prepare, file and serve their trial bundle.
f) This matter will be heard on 29.05.2026 in open Court.
g) Witness Summons do issue to the County Land Registrar Uasin Gishu to attend Court and produce the parcel file of the properties known as Eldoret Pioneer/Ngeria Block 1(EATEC) /1998 and 1999 to verify the ownership of the same on the 29.05.2026.
h) The Plaintiff Counsel will extract the summons and effect service on the County Land Registrar Uasin Gishu within the next seven (7) days.
i) All parties are requested to ensure that all their witnesses are present on the 29.05.2026 for hearing.
