RULING
1. The Application dated 10.06.2026 is compromised as follows;
a) In the interest of justice, the Memorandum of Appeal dated 5.06.2026 and filed on 16.06.2026 be and is hereby deemed as duly filed.
b) The Appellant is granted leave of 45 days from today’s date to prepare file and serve the Record of Appeal.
c) The Judgement of the Trial Court dated 5.05.2026 be and is hereby stayed pending the hearing and determination of the main Appeal.
d) The County Land Registrar Uasin Gishu is hereby directed to register an inhibition of the Register of the property known as L.R Uasin Gishu/Simat Block 1(Yamumbi)/733 pending the hearing and determination of the main Appeal.
e) The 2nd Respondent be and is hereby ordered by way of a prohibitory injunction from doing any excavation and/or interfering with the suit property pending the hearing and determination of the main Appeal.
f) The costs of this Application will abide the outcome of the main Appeal.
g) The matter will be mentioned on 6.08.2026 before the Deputy Registrar to confirm that the Record has been filed and fix a date for admission of the Record before the Judge.
