Directions
1. Upon the Applicant's Notice of Motion dated 20th May 2026 coming up for directions before Lady Justice Mwanaisha S Shariff this 22nd day of June 2026, I have duly considered the same, the affidavit in support thereof sworn by Eric Murimi Kaburu on even date, the annexures attached thereto and the certificate of urgency issued on even date by Elly Okoth Esquire advocate and I note that the applicant has cited non services of court processes in Milimani MCCCMISC/E123/2026 and the attachment of his motor vehicle Registration Number KDE 313W – Toyota Prado (Black) in execution of the ex parte judgment delivered on 23.1.2026. I thus find that urgency has been demonstrated. I thus direct as hereunder:
a) This application is certified as urgent.
b) The same be served within 2days and a response be filed and served within 7 days from the date hereof.
c) Inter parte hearing is scheduled on 30th June 2026.
d) An interim order of stay of execution is granted in respect of the judgment delivered on 23.1.2026 in Milimani MCCCMISC/E123/2026 until 30.6.2026.
