Ruling
1. Upon the applicant's Notice of Motion dated 12th June 2026 coming up for directions before Lady Justice Mwanaisha S Shariff in the first instance this 16th day of June 2026, I have duly considered the same, the affidavit in support thereof sworn by Amina Siyat Hanshe on even date, the annexures attached thereto and the certificate of urgency issued on even date by Kasire Felix Esquire advocate and I note that whereas the applicant has deposed that the respondent has contravened stay orders granted on 30.5.2026 by the subordinate court and that execution has commenced, no evidence has been adduced to support both averments. I however appreciate the fact that the applicant has already lodge this appeal. I thus direct as hereunder :
a) This application is not certified as urgent.
b) b) The same be served within 3 days and a response be filed and served within 10 days from the date hereof.
c) Inter parte hearing by way of oral submissions is scheduled on 30Th June 2026.
d) An order of interim stay of execution is grant in respect of the judgment delivered on 25Th May 2026 in Milimani SCCC/ E2800 of 2025 until 30th June 2026.

Given under my hand and seal of this court at Milimani this 16th day of June 2026.
