Directions
1. Upon the applicant's Notice of Motion dated 10th June 2026 coming up for directions before Lady Justice Mwanaisha S Shariff this 16th day of June 2026, I have duly considered the same, the affidavit in support thereof sworn by Kajuju Marete on even date, the annexures attached thereto and the certificate of urgency issued on even date by Vincent Juma Esquire advocate and I note that the applicant has cited an alleged delay by the subordinate court in uploading the ruling as the cause for it’s own delay in lodging an appeal timeously and I thus find that urgency has been demonstrated. I direct as hereunder :
a) This application is certified as urgent.
b) The same be served within 2 days and a response be filed and served within 7 days from the date hereof.
c) Inter parte hearing is scheduled on 25Th June 2026.
d) An interim order of stay of execution is grant in respect of the decree on costs made on 23.1.2026 in Milimani CMCC NO 5265 of 2017 until 25.6.2026.
