THE CHIEF MAGISTRATE’S COURT AT MOMBASA

RULI

  1. The Applicant was charged and convicted on his plea of guilty for the offence of creating disturbance in a manner likely to cause a breach of the peace contrary to Section 95(1)(b) of the Penal Code and malicious damage to property contrary to Section 339(1) of the Penal Code. The Applicant was sentenced to 14 days imprisonment on the 17th June, 2024
  2. The sentence review report dated 17th October, 2024 by Ramadhan Mohamed indicated that the file has been overtaken by events as the Applicant has already been released from prison.
  3. Having considered the Sentence Review Report, I find that since the applicant has already served his sentence and been released, the Application has been overtaken by time. Therefore, the Application is dismissed.
