The Applicant was convicted of the offence of Preparing to commit a felony contrary to section 308 (2) of the penal code on the 12th day of October 2023 In Mombasa CR  CASE NO E 1089 OF 2023. He was sentenced to serve 6 months in prison on the 22nd day of December 2023.
He then sought for a review of the sentence and on 8th March 2024, My Sister,LJ Onginjo ,requested for a Sentence Review Report.  The said report was not availed in good time and it has now been overtaken by events as the Applicant served his sentence and was released from custody.
Accordingly, the application is spent and moot.
The review file is hereby closed.
The  lower  court file be returned to their  registry.
