(From the original Conviction and Sentence in the Chief Magistrates’ Court at Nyamira, Criminal Case No. 255 of 2020 by Hon. W.C. Waswa Resident Magistrate on 21st December 2021.)
The Applicant was convicted of the offence of Personation contrary to Section 382 of the Penal Code, Cap 63 Laws of Kenya. The trial court sentenced him to pay a fine of Kshs. 200,000/= or to serve 4 years’ imprisonment in default. The Applicant has already served 4 years and therefore completed his sentence. The Revision of Sentence has therefore been overtaken by events as he was released 21st August 2024. I hereby direct that the file be closed forthwith.
Orders accordingly.
