RULING
THIS MATTER is an Application filed under a Certificate of Urgency, notice of motion and supporting Affidavit by Applicant evenly dated 29th July 2025, coming up before Hon. Justice Mohochi S.M. AND UPON READING the Notice of Motion together with the supporting Affidavit, sworn by Kellen Kimure. The court directs and Orders on the following terms;
IT IS HEREBY ORDERED;
1. THAT, this Application is certified as urgent to be heard ex-parte and its service is dispensed with.
2. THAT no prejudice shall be occasioned upon the parties should the prayers thereon be allowed and that the same shall be in the interests of expediting delivery of justice.
3. THAT, this court lacks jurisdiction to sit on Appeal in matters Employment and Labour Relations.
4. THAT that an Order is hereby issued forthwith transferring High Court Appeal (HCA) No E168 of 2025 to the Employment and Labour Relations Court at Nakuru for hearing and determination.
