(From the original Conviction and Sentence in the Senior Principal Magistrates’ Court at Keroka, Criminal Case No. MCCR E406 of 2022 by Hon. B. Kimtai, Senior Principal Magistrate on 14th July 2022)
The Applicant was convicted on his own plea of guilty for the offence of house breaking contrary to Section 304 (1) (b) and Stealing contrary to Section 279 (b) of the Penal Code. The trial court sentenced him to serve 6 years’ imprisonment. The Applicant has served 1 year 9 months of his sentence. The Sentence Review Report filed on 3rd April 2024 by the Probation Officer Johnstone Mpaera does not recommend a non-custodial sentence due to hostility from the community members. I hereby direct that the Applicant continues to serve the remaining part of his sentence in custody.
Orders accordingly.
DATED and DELIVERED at NYAMIRA on this 13th day of MAY 2024.
