(From the original Conviction and Sentence in the Senior Principal Magistrates’ Court at Keroka, Criminal Case No. MCCR E249 of 2023 by Hon. B. Kimtai, Senior Principal Magistrate on 27th July 2023)
The Applicant was convicted for the offence of burglary contrary to Section 304 (2) and stealing contrary to Section 279 (b) of the Penal Code. The trial court sentenced him to serve 5 years imprisonment for both limbs of the charge. The Applicant has already served 7 months of his sentence. The Sentence Review Report filed on 3rd April 2024 by the Probation Officer Daisy Langat does not recommend a non-custodial sentence because he has 2 years and 8 months to complete his sentence and the community is still hostile towards him. I hereby direct that the Applicant continues to serve the remainder of his sentence in custody.
