(From the original Conviction and Sentence in the Senior Principal Magistrates’ Court at Nyamira, Criminal Case No. MCCR E298 of 2023 by Hon. B.M. Kimtai, Senior Principal Magistrate on 15th May 2023).
The Applicant was convicted on his own plea of guilty for the offence of malicious damage to property contrary to Section 339 (1) of the Penal Code. The trial court sentenced him to serve 3 years’ imprisonment. The Applicant has already served 9 months of his sentence. The Sentence Review Report filed on 3rd April 2024 by the Probation Officer Mpaera Lerionka Johnstone recommends a non-custodial sentence. I hereby direct that the Applicant shall serve a Community Service Order at Nyaribari Central Location Chief’s Office under the supervision of the area chief Mr. Kepha Nyakundi for the remaining part of his sentence.
