(From the original Conviction and Sentence in the Senior Principal Magistrates’ Court at Keroka, Criminal Case No. MCCR E840 of 2022 by Hon. M. Munyekenye, Senior Principal Magistrate on 13th December 2023)
The Applicants were each convicted on their own plea of guilty for the offence of obtaining money by false pretence contrary to Section 313 of the Penal Code. The trial court sentenced each of them to pay a fine of Kshs. 30,000/= or in default to serve 18 months imprisonment. The 1st Applicant has already served 3 months of his sentence. The Sentence Review Report filed on 3rd April 2024 by Probation Officer Daisy Langat recommends a non-custodial sentence. I hereby direct that the Applicant serves a Community Service Order at Mochenwa Location Chief’s Office under the supervision of the area chief Mr. Magara for the remaining part of his sentence.
There is no sentence review report on Record for the second Applicant.
