ELISHA K. BUSIENEI AND TILMWAI LOGISTICS LIMITED VS COUNTY GOVERNMENT OF UASIN GISHU AND NATIONAL BANK OFKENYYA

RULING

By consent, the Application dated 16.04.2025 be and is hereby settled based on the following orders;

1. The Applicant known as Mamusi Enterprises Limited be joined in the suit as the 3^rd Defendant.
2. The Plaintiffs are granted leave of 14 days from today’s date to prepare, file and serve the Amended Plaint on all the parties.
3. The 1^st Defendant is granted leave of 21 days upon service of the Amended Plaint to prepare, file and serve their Amended Defence and Amended Counter-Claim if need be and serve on all the parties.
4. The 3^rd Defendant and any other party will have leave of 21 days upon service of the Amended Defence and Amended Counter-Claim to prepare, file and serve their Reply to the Amended Defence and Amended Counter-Claim by the 1^st Defendant.
5. The 1^st Defendant will have leave of 21 days upon service of the Defence to the Amended Counter-Claim to prepare, file and serve a Reply to the Defence on the Amended Counter-Claim.
6. The matter will start de novo.
7. There will be no costs to this application.
8. The matter will come up for pre-trial on the 13.11.2025.
