RULING
1. The matter is hereby adjourned on the Application of the Defendant.
2. This is marked as the last adjournment on the part of the Defendant.
3. The Application dated 26.01.2026 is allowed.
4. The 1st, 2nd, and 3rd Defendants are granted leave of 7 days from today’s date to file their Amended Defence and Counter-Claim together with any other witness statements and/or List of Documents.
5. The Plaintiff will have leave of 7 days upon service by the Defendant to prepare, file and serve their Reply to Defence if need be together with any other they intend to rely upon for their Defence of the Counter-Claim.
6. The Defendant will have leave of 7 days upon service of the Defence to the Counter-Claim to prepare, file and service the Reply to Defence on the Counter-Claim.
7. By consent, the matter is fixed for hearing on the 15.04.2026 in open Court.
8. The matter will be mentioned on 23.03.2026 for pre-trial.
9. The Defendants are condemned to pay the Plaintiff costs assessed at Kshs.3,000 and the Plaintiff advocates attendance costs.
