DR. ERASTUS SIFUNJO KISAKA VS UNIVERSITY OF NAIROBI

High Court at Milimani High Court · · Jairus Ngaah

I have read the applicant's application dated 12 April 2024 filed under a certificate of urgency of even date. I am satisfied, for reasons given in the certificate of urgency, that the application is urgent and it is so certified. Upon perusal of the application, I am satisfied that the applicant has an arguable case for judicial review reliefs of certiorari, mandamus and prohibition. Accordingly, leave is hereby granted for the applicant to file a substantive motion for judicial review reliefs in terms of prayers (b) (c) and (d) of the chamber summons. I direct that the substantive motion be filed and served within 7 days of the date of this ruling. Apart from the respondent, the motion shall also be served upon the Kenya Revenue Authority. The respondent shall file and serve its response to the application within 7 days of the date of service of the motion. The motion shall then be mentioned on 20 May 2024 for purposes of taking directions on the model of its hearing. In the meantime, the leave granted shall operate as stay in terms of prayer (e) of the chamber summons. It is so ordered
