I have read the applicant's application dated 15 May 2024 filed under a certificate of urgency of even date. I am satisfied that the application is urgent and it is so certified. I am also satisfied that the applicants merit the exercise of this Honourable Court's discretion in their favour for leave to file a substantive motion for judicial review reliefs of certiorari and prohibition. Accordingly, leave is granted in terms of prayers 2 (a) and (b) of the chamber summons. I am also satisfied that pending the determination of the question whether the respondent's impugned circular dated is tainted by any of the grounds of judicial review stated in the statutory statement, the grant of leave shall operate as stay. Accordingly, leave shall operate as stay of the respondent's circular dated 15 April 2024 referenced PRSA/PSO/204(4) pending the hearing and determination of the substantive motion or until further orders from this Honourable Court.
Directions with respect to the filing and the disposal of the substantive motion are as follows:
1. The motion shall be filed and served within 7 days of the date of this ruling.
2. The respondent and interested parties shall file and serve their response to the motion within 7 days of the date of service of the motion.
3. Directions on the hearing of the motion shall be given on 5 June 2024.
It is so ordered.
