ASSOCIATION OF INSURANCE BROKERS OF KENYA VS KENYA ELECTRICITY GENERATING COMPANY LIMITED

High Court at Milimani High Court · · Jairus Ngaah

I have considered the applicant's application dated 20 May 2024 filed under a certificate of urgency of even date. I am satisfied that the application is urgent and it is so certified. I am also satisfied that the application merits grant of leave for the applicant to file a substantive motion for judicial review reliefs. Leave is, therefore, granted in terms of prayers 2, 3 and 4 of the chamber summons. The prayer for leave to operate as stay is declined but the applicant is at liberty to move the court appropriately for interim relief once the substantive motion has been filed and served. Meanwhile, I direct that the motion be filed and served within 7 days of the date of this ruling. The respondent is directed to file and serve its response to the motion within 7 days of the date of service of the motion. The motion shall be mentioned on 5June 2020 for purposes of taking directions on the mode of its disposal. It is so ordered.
