High Court at Bungoma High Court · · M.S.Shariff

Ruling

1. Upon the appellant's Notice of Motion Dated 2.2.2026 coming up for hearing before me this 4.2.2026 at the ex parte stage, I have duly considered the same, the affidavit sworn by Omar Ahmed Yusuf on even date and the enclosures attached thereto and I do find that the short time frame given for compliance reveals urgency. I thus direct as follows ;-

i) This application is certified as urgent.

ii) The same be served within 3 days and a response be filed within 7 days from the date hereof.

iii) Inter partes hearing is set on 12.2.2026.

iv) An order of stay of execution of the ruling delivered on 26.1.2026 in Sirisia MCCC E211/2024 is hereby granted until 12.2.2026.

Delivered, Signed and Dated at Bungoma this 4.2.2026.
