Ruling
1. The Applicant Timothy Wanjala Wekesa is an auctioneer trading as Timpech Auctioneers. He has moved this court craving for orders for provision of security as he undertakes the execution process. He is not a party in this appeal and has an instructing principal who ought to have moved this court. It is not worthy that the Applicant has erroneously intituled this appael as a suit by making reference to plaintiff and defendant.
2. I do find that the application herein is incurably and fatally defective due to reasons aforestated and I thus strike it out.
