The Accused person in this matter is charged with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code.
The particulars of the offence are that Hesbon Okeyon Nyayiemi on the 28th day of January 2023 at Nyamware village, Suna Ngege Sub-Location, Suna Central Location, Suna East Sub-County in Migori County within the Republic of Kenya murdered Shania Precious Otieno.
The prosecution adduced evidence of 9 witnesses in support of the charge against the Accused person.
The defence Counsel filed submissions dated 4th February 2026 and submitted that the prosecution had not proved a prima facie case sufficient to place the Accused on defence.
This court has however considered the totality of the prosecution evidence and is satisfied that a prima facie case has been established sufficient to require the Accused person to respond to the allegations raised against him. He has a case to answer and is placed on his defence.
