Onyango : Iam for appellant /applicant. The firm of Kiplenge and Andama are for respondent. I cannot see the4m on the platform. We served them and they served us with aq replying affidavit . We seek that since this is a small claims appeal we do away with the application on the following terms :
1. We open a joint interest earning account with the respondents’s counsel for deposit of the decretal amount.
2. Decretal sum be deposited therein within 30 days from today.
3. Record of appeal be filed and served within 30 days from today.
4. Mention after 30 days.
court : Counsel for the respondent is absent. it is now past 9.30 am .
Ruling
I have heard counsel for the applicant exparte on the application dated 17.6.26.
The proposal by counsel is reasonable and will expedite the matter. I allow the application on condition that :
1. Both Counsel for the appellant and respondent to open a joint interest account in the names of their firms .
2. The decretal sum be deposited in that account within 30 days from today.
3. Record of appeal be filed and served within 30 days from today.
4. Mention on 4.11.26 for compliance
