Nyasimi : we have agreed that prayer 3 of the notice of motion dated 4.12.25 be granted on condition that the appellant /applicant ot deposit 1/2 of the decretal sum in a joint interest earning account in the names of both counsel within 35 days . The expenses if any of the opening the account be borne by the respondent /

Nyasimi : My client is willing to deposit half the sum .
Directions : Deposit of half decreal sum would be fair and just since the appeal is pending .
Ruling :
Prayer 3 of the application dated 4.12.25 is allowed on condition that the applicant/appellant deposits half of the decretal sum in a joint interest earning account to be opened in the joint names of both firms of advocates for the parties herein within 35 days from today. . The expenses of opening the account if any to be borne by the respondent. Record of appeal be filed and served within 60 days from today. Mention on 28.5.26.
