Omandi : we have a consent ; By consent of advocates appearing for both parries , the notice of motion applications dated 14.2.25 and 18.3.25 be allowed on the following terms;
a. That there be stay of execution of judgment and decree in Kisii CMCC no 926 of 2022 pending the hearing and determination of this appeal .
b. The appellant applicant do pay half the decretal sum plus cost of the lower court to the respondent and deposit the other half in a joint interest earning account to be opened in the joint names of the firms of advocates for both parties .
c. the respondent be and is hereby granted leave to file a cross appeal within 7 days from today .
RULING
The consent is considered the same is adopted as recorded . Mention on 9.3.26 for compliance before the DR
