I have considered the applicant's application dated 28 April 2023 filed under a certificate of urgency of even date. By dint of section 175(3) of the Public Procurement and Asset Disposal Act, the application is certified urgent. Leave is granted in terms of prayers 2, 3 and 4 of the summons. Directions on the filing and disposal of the application are as follows:
1. The motion shall be filed and served within 3 days of the date of this ruling.
2. The response to the motion shall be filed and served within 3 days of the date of service of the motion.
3. The motion shall be disposed of by way of written submissions and in that regard:
(a) The applicant's submissions shall be filed and served within 3 days of the date of service of the respondents' and interested parties' response to the motion.
(b) The respondents' and interested parties' submissions shall be filed and served within 3 days of the date of service of the applicants' submissions.
(c) The suit shall be mentioned on 16 May 2023 to reserve it for judgment.
