PROF TOM OJIENDA & ASSOCIATES ADVOCATES VS NAIROBI CITY COUNTY

I have read the applicant's motion dated 30 August 2023 sought to be disposed of during this Honourable Court's  current recess by yet another application of even date. It is apparent from the face of the application that the certificate of taxation from which a judgment is sought was obtained in February 2023. That being the case no reason has been proffered why the applicant has to move this Honourable Court during its recess to dispose of an application that ought to have been filed five or so months ago. I am not satisfied that the application is urgent. I direct that the same be served for hearing during the ordinary session in October, more particularly on 16 October 2023. It is so ordered.
