ONE CLEAR MISSIONS ORGANIZATION VS State Law Office AND Central Planning and Monitoring Unit AND 2 Others

High Court at Mombasa High Court · · Jairus Ngaah

I have read the applicant's application dated 3 August 2026, filed under a certificate of urgency, seeking to have the application for conservatory orders heard during this honourable court's August recess. It is not clear from the applicant when it became aware of the over-enrolment of the children in the 1st respondent's institution. If the enrolment over and above the acceptable limits has been going on for several years, then no sufficient explanation has been proffered as to why the applicant has chosen to file the application while the court is on recess. In the circumstances, I am not satisfied that the application is urgent. Nonetheless, for the benefit of the interests of the children, I hereby direct that the application shall be disposed of on priority basis and, to that end, direct as follows:
(a) The application will be heard soon after the ordinary sessions resume in the new term and will be listed on 21 September 2026 for highlighting of submissions.
(b) In the meantime, the application shall be served forthwith and, in any event, not later than the close of business tomorrow, 11 August 2026.
(c) The respondents have seven days to file their response after service of the application.
(d) The applicant will file and serve submissions on the application within 7 days of the date of service of the respondents' response. (e) The respondents will file and serve their submissions within 7 days of the date of service of the applicant's submissions.
