I have read the applicant's application dated 10 August 2026, which is sought to be heard during this Honourable Court's August recess. I gather from the application that the administrative and legal regime for clearance of containerised cargo, which the applicant seeks to halt, is already underway and is being implemented. In these circumstances, conservatory orders may not issue before the respondents have been heard. For the same reason, I am not satisfied that the application is urgent to the degree that it has to be heard during this Honourable Court's August recess. Nonetheless, the disposal of the application and the appeal can be expedited and heard as soon as the court resumes from its recess. To this end, I hereby direct as follows:
(a) The application and the petition shall be served forthwith and, in any event, not later than tomorrow, 11 August 2026.
(b) The respondents shall file and serve their responses both to the petition and the application for conservatory orders within 7 days of the date of service of the applicants' pleadings.
(c) The applicant will file and serve submissions both on the application and the petition within 7 days of the date of service of the respondents' response.
(d) The respondents will file their submissions in response within 7 days of the date of service of the applicant's submissions.
(e) Subject to any directions that the court may deem appropriate to give, highlighting of submissions on the application for conservatory orders will be on 22 September 2026.
