RULING

THIS MATTER is an Application filed under a Certificate of Urgency, dated 8th April 2024, coming up before Hon. Justice Mohochi S.M. AND UPON READING the Summons for Rectification of grant together with the supporting Affidavit dated 5th April 2024 sworn by Mary Wambui the court  finds favor allowing the Application on the following terms;

IT IS HEREBY ORDERED;

  1. THAT, the Application is certified as urgent and its service is dispensed with.
  2. THAT, an Order is hereby issued to M/S Applecross Valuers to forthwith access and value the matrimonial home on parcel LR NO. NAKURU MUNICIPALITY BLOCK 25436.
  3. THAT, the Officer commanding Bahati Police Station do give security to the valuer Mr. Kariuki of Applecross Valuers during the valuation exercise.
  4. THAT, Costs of this Application shall be in the cause.
