ORDERS
THIS MATTER is an Application filed under a Certificate of Urgency, coming up before Hon. Justice Mohochi S.M. AND UPON READING the chamber summons together with the supporting Affidavit of Munene Muyuro Advocate, Ex-parte Chamber Summons, together with the supporting Affidavit of Munene Muyuro Advocate all evenly dated 9th September 2024, noting that the same seeks a variation of the Orders dated 30th October 2023 and that no prejudice shall be occasioned with the variation sought. The court directs and Orders on the following terms;
IT IS HEREBY ORDERED;
1. THE application is certified as urgent warranting its hearing ex-parte and dispensing with service of the same.
2. THAT, the Orders of this Court Made on the 30th October 2023 Are Not “Null and Void” as alleged by the Intrested Party and remain valid orders, uncontested and fit for enforcement
3. THAT, this court hereby varies the Orders Dated 30th October 2023 and extend the Same to the Intrested Party – The Lands Registrar for Nakuru County.
4. THAT, for avoidance of doubts, this Court hereby Orders and Commands the Lands Registrar for Nakuru County to forthwith Remove and Lift the Restriction registered against on the parcel of land known as NAKURU MUNICIPALITY BLOCK 2/195 and PANGANI NAKURU PLOT No.247.
