' 1. I have perused the Notice of Motion dated 19th November 2025 vide which the Appellant/Applicant seeks the stay of execution of the ruling delivered by the Hon O. K. Onalo, SRM, on 14th November 2025 in Msambweni Children Case No E016 of 2024, pending the hearing of the application interpartes.
2. Although the application appears to me as being urgent, the appeal, and consequently the instant application, ought to have been filed at the Kwale High Court. Under the circumstances, I direct that the application be served forthwith on the Respondent for an interpartes hearing on 25th November 2025.
