' 1. I have read the Notice of Motion dated 17th November 2025, the attached affidavit of Mr Lawrence Maruti, as well as the annexures thereto. I note that this Court has previously granted the Appellant/Applicant time to deposit the decretal sum, which the said party has not done to date.
2. Vide the application under consideration, the Appellant/Applicant seeks a further 14 days to do so, on the grounds that it has not been able to deposit the decretal sum due to internal administrative delays, which is disingenuously given as being beyond its control. The idea that "internal administrative delays" are beyond the control of the Appellant/Applicant is mindboggling.
3. Given the circumstances, I am unable to agree that the application is urgent. There are better uses of judicial time than hearing an application filed by a party that is clearly determined not to comply with the directions of the court. I decline to certify the application dated 17th November 2025 urgent. I direct that the same be served on the Respondent within three days of the date hereof for an interpartes hearing on 18th December 2025.
4. It is so ordered.
