RULING
1. The Consent upon hearing of the Application dated 19.01.2026, it is clear that the Applicant is a purchaser on Plot No.44.
2. However, the portion he purchased is not within the area of dispute.
3. The Court has explained to the Applicant that his portion is not under litigation but the Applicant insists on joinder.
4. Consequently, so that justice is seen to be done, the Applicant Isaac Kiptarus Mutai is joined as the 1st Interest Party in this suit.
5. The 1st Interested Party is directed to ensure all his documents are in file and served all parties by the 02.03.2026 when the matter will come up for pre-trial.
