CONFIRMATION OF GRANT
1. Before the Court is the Chamber Summons dated 9th July 2026 brought by the Executors, Adili Executor Services Limited and Nasrin Jadin Jiwa Shamji also known as Nasrin Tajdin Shamji Dewany, seeking confirmation of the Grant of Probate of Written Will issued on 21st January 2026.
2. The application is brought pursuant to sections 71(1) and (2) of the Law of Succession Act and Rule 40(1) of the Probate and Administration Rules and is supported by the affidavit sworn by the Executors on 9th July 2026.
3. The deceased, Shanif Dewany, died on 17th August 2023 leaving a written Will dated 8th August 2023 which was proved before this Court. A Grant of Probate of Written Will was subsequently issued to the Executors on 21st January 2026.
4. I have considered the Chamber Summons, the supporting affidavit, the Grant of Probate, the written Will of the deceased, the consents filed by the surviving spouse and the two adult sons of the deceased, and the entire court record.
5. More than six months have elapsed since the issuance of the Grant and the requirement under section 71(1) of the Law of Succession Act has therefore been satisfied.
6. The assets and liabilities of the estate have been disclosed. The deceased was survived by his widow, Nasrin Jadin Jiwa Shamji also known as Nasrin Tajdin Shamji Dewany, and his two adult sons, Saahir Shanif Dewany and Shayan Dewany. There is no protest, objection or challenge to either the validity of the Will or the authority of the Executors. Each of the beneficiaries has consented to the confirmation of the Grant.
7. The Executors have stated that the estate shall be distributed in accordance with the deceased's last Will dated 8th August 2023. Upon examining the Will and the material placed before the Court, I am satisfied that the proposed mode of distribution accords with the testamentary wishes of the deceased.
8. I am further satisfied that there is no pending application for provision for dependants and no unresolved issue concerning the administration, liabilities or distribution of the estate that would render confirmation premature.
9. Accordingly, the Chamber Summons dated 9th July 2026 is allowed. The Grant of Probate of Written Will issued on 21st January 2026 is hereby confirmed. The estate shall devolve in accordance with the Last Will and Testament of the deceased dated 8th August 2023 and a Certificate of Confirmation of Grant shall issue accordingly. There shall be no order as to costs.
