CONFIRMATION OF GRANT
1. Before the Court is the Summons for Confirmation of Grant dated 8th May 2026 brought by the Executors, Sanjeev Kumar Khagram, Rajeev Kumar Khagram and Rupeen Kumar Khagram, seeking confirmation of the Grant of Probate issued on 7th November 2023.
2. The application is brought pursuant to sections 55 and 71 of the Law of Succession Act and Rule 40 of the Probate and Administration Rules and is supported by the affidavits on record.
3. The deceased, Kantilal Devchand Nanji Khagram, died on 28th October 2019 leaving a written Will which was proved before this Court. A Grant of Probate of Written Will was subsequently issued to the Executors on 7th November 2023.
4. I have considered the Summons, the affidavits filed, the Grant of Probate, the Will of the deceased and the entire court record.
5. More than six months have elapsed since the issuance of the Grant and the requirement under section 71(1) of the Law of Succession Act has therefore been satisfied.
6. The assets of the estate have been disclosed and there is no protest, objection or challenge to either the validity of the Will or the authority of the Executors.
7. The further affidavit filed herein confirms that under the terms of the Will, the sole beneficiary of the deceased's estate is his widow, Usha Kantilal Khagram. Upon examining the Will, I am satisfied that the proposed distribution accords with the testamentary wishes of the deceased.
8. I am further satisfied that there are no unresolved issues concerning administration, liabilities or distribution that would render confirmation premature.
9. Accordingly, the Summons for Confirmation of Grant dated 8th May 2026 is allowed. The Grant of Probate issued on 7th November 2023 is hereby confirmed. The estate shall devolve in accordance with the Last Will and Testament of the deceased and a Certificate of Confirmation of Grant shall issue accordingly. There shall be no order as to costs.
