CONFIRMATION OF GRANT
1. Before the Court is the Summons for Confirmation of Grant dated 30th May 2026 brought by the executor, Stephen Abraham Kizito, seeking confirmation of the Grant of Probate of Written Will issued on 20th November 2025. The application is brought pursuant to sections 55 and 71 of the Law of Succession Act and Rule 40 of the Probate and Administration Rules and is supported by the affidavits on record.
2. The deceased, Samuel Geoffrey Kiggwe Kizito, died testate on 24th January 2003. His written Will dated 30th June 2001 was proved before this Court and a Grant of Probate of Written Will was issued to the executor on 20th November 2025.
3. I have considered the Summons, the affidavits filed, the Grant of Probate, the Will of the deceased and the entire court record.
4. More than six months have elapsed since the issuance of the Grant and the requirement under section 71(1) of the Law of Succession Act has therefore been satisfied.
5. The assets of the estate have been disclosed and the beneficiaries identified. The executor has confirmed that there is no application for provision for dependants pending and that no estate duty remains payable. There is no protest, objection or challenge to either the validity of the Will or the authority of the executor.
6. Upon examining the Will together with the further affidavit filed in support of the application, I am satisfied that the proposed administration and distribution accords with the testamentary wishes of the deceased as expressed in his written Will.
7. I am further satisfied that there are no unresolved issues concerning administration, liabilities or distribution that would render confirmation premature.
8. Accordingly, the Summons for Confirmation of Grant dated 30th May 2026 is allowed. The Grant of Probate of Written Will issued on 20th November 2025 is hereby confirmed. The estate shall devolve in accordance with the Last Will and Testament of the deceased and a Certificate of Confirmation of Grant shall issue accordingly. There shall be no order as to costs.
