JUDGEMENT
By consent, the matter is hereby settled in the following manner;
1) The Survey Report by the County Surveyor dated 3.04.2026 is hereby adopted by this Court.
2) Based on the Survey Report dated 3.04.2026, the Plaintiffs and Defendant confirm that there is no encroachment of the Plaintiff property known as L.R 7914 by the Defendant that affects the proprietary interests of either party.
3) The boundary dispute between L.R No.7914 and Eldoret Municipality Block 28 (Mushroom)/82 & 83 and the sub-division emanating from the said parcels of land and Eldoret Municipality Block 28/485 be and is hereby marked as determined by the Survey Report dated 3.04.2026.
4) Each party will bear its own costs related to this suit.
5) The file is closed.
