RULING

  1. Due to the need of referring to the proper documents that created the various portions of land, it is important that the Court is furnished with the Maps and Folios that were used to create the properties.
  2. Consequently, PW1 is hereby stood down.
  3. The Director of Survey and/or any other relevant office is directed to produce and furnish the Mutations and/or Folios that were used to create the following properties;
  4. The Mutation and Folio that was used to create the property known L.R 8149 (I.R 9049) ELDORET.
  5. The Mutation and Folio that created the property known L.F ELDORET MUNICIPALITY BLOCK 15/5.
  6. The Mutation and Folio that created the properties known as ELDORET MUNICIPALITY BLOCK 15/16 & ELDORET MUNICIPALITY BLOCK 15/17.
  7. The Mutation and Folio that sub-divided the property known as ELDORET MUNICIPALITY BLOCK 15/17.
  8. The Director of Survey is requested to ensure that the above documents are availed before the Court on or about 27.11.2025.
  9. The matter will be mentioned on 27.11.2025 to confirm compliance.
  10. The 5th Respondent will extract the order above and serve on the Director of Survey.
