JUDGEMENT

Based on the admission by the 1st Defendant, the court hereby makes the following orders in determination of this suit with the consent of the counsel for both parties.

  1. The 1st, 2nd and 3rd Defendants are hereby ordered and/or directed to hand over the completion documents of the property known as L.R UASIN GISHU /KIMUMU/9083 measuring 0.20 Ha to the Plaintiffs within 30 days from today’s date.
  2. For avoidance  of doubt, the completion documents will include the Transfer Form, the Application for consent, the consent letter, copies of the K.R.A Pin numbers or the 1st, 2nd and 3rd Defendants, copies of the ID and three pictures of the 1st, 2nd and 3rd Defendants together any other documents that will be required to facilitate the transfer.
  3. The Plaintiff is liable for the costs of transferring the property known as L.R No. |Uasin Gishu/Kimumu/9083 from the 1st – 3rd Defendants to himself.
  4. Each party will bear its own costs in relation to this suit.
  5. The orders issued on 08.04.2022 regarding the property known L.R UASIN GISHU/KIMUMU SETTLEMENT SCHEME/107 are hereby reviewed, vacated and/or lifted.
