THE CHIEF MAGISTRATE’S COURT AT MOMBASA (HON D .ODHIAMBO)
- The Applicant was charged and convicted under section 215 of the CPC FPR THE OFFENCE OF UNAUTHORISED DISCONECTION OF ELECTRICAL APPARATUS CONTRARY TO SECTION 168 (10 (D) OF THE ENERGY ACT . 2019 . The Applicant was sentenced to ONE YEAR IN PRISIN AND AN ADITIONAL FINE OF KSH 300,000 AND IN DEFAULT TO SERVR AN ADDITIONAL YEAR imprisonment on the 4th day of April , 2024.
- The sentence review report dated 11th November, 2024 by BOYTONE OMONDI indicated that in mate has learnt his lesson and is willing to change. .The family and community sentiments were also positive and they are willing to receive him.
- Having considered the Sentence Review Report, I find that since the applicant has learnt his lesson HE DESRVES A SECOND CHANCE . His sentence is reviewed to the time already spent in custody plus a further 6 MONTHS COMMUNITY SERVICE AT CHAANI CHIEFS OFFICE FOR A PERIOD OF ONE YEAR. THE SENTENCE REVIEW AS IN RESPECT TO THE ONE YEAR SENTENCE AS WELL AS THE SENTENCE ON THE PAYMENT OF A FINE.
